Navigating Proposition 19

Before the 2021 overhaul of California property tax law, children could inherit a parent’s low Proposition 13 tax base for a primary residence and other real estate, regardless of their own occupancy. Currently, Proposition 19 imposes these two strict requirements on inherited residences:

  • The inherited home must become the child’s primary residence within one year of transfer.
  • The tax benefit is capped. If the market value of the home exceeds the parent’s current tax base plus an inflation-adjusted amount (currently $1,044,586 for 2025-2027), the excess value is reassessed to current market rates.

If the child who inherited the home does not move in within one year of transfer, the property is fully reassessed, immediately multiplying the property tax bill. Investment and rental properties are fully reassessed without exception.
